헤겔의 인륜성의 철학은 근대 사회에서 걸맞는 인륜성의 이념을 구성하려는 시도이다. 「자연법」 논문(1802~1803)에서 이루어진 근대 자연법 이론에 대한 헤겔의 비판은 바로 이러한 실천철학적 작업의 일환으로 수행된 것이었다. 그는 이 논문에서 근대 자연법 이론이 인륜적 공동체를 개인들의 사적 이익 추구를 위한 수단이나, 개인들을 억압하는 강압적 지배 체제로 파악한다고 주장하면서, 이 이론들은 모두 인륜적 공동체와 개인들간의 유기적이고 생동하는 통일을 이룬 근대적 인륜성의 이념을 구상하는데에 실패했다고 비판한다. 그는 이러한 실패의 주된 원인이 저 이론들이 취하는 학문적 방법인 ‘추상’에 있다고 보면서, 이 방법에 함축되어 있는 논리적 비일관성과 모순점을 근본적으로 비판하고자 한다. 본 논문에서는 헤겔이 근대 자연법 이론의 두 학적 취급 방식이라 칭한 경험주의 자연법 이론과 형식주의 자연법 이론에 대한 그의 비판의 요지를 재구성하여 제시했고, 이 비판의 타당성을 비판적으로 검토해 보았다. 우리는 두 이론을 대표하는 철학인 홉스와 칸트의 자연법 이론에 대한 헤겔의 비판에 주목하여, 그의 비판이 이 이론들의 자체 내적인 논리에 충실하지 않은 채로, 특히 추상의 방법에 대한 오해에 근거를 두고서 이루어졌기 때문에, 내적 비판으로서는 한계를 지닐 수밖에 없음을 입증하려 했다.
Hegel's philosophy of the ethical life(Sittlichkeit) is an attempt to construct an idea of the ethical life suitable for the modern society. Hegel’s criticism on the modern theories of natural law in the paper “Natural Law”(1802~1803) was performed as a part of his practical philosophy designed to reconstruct the new idea of the modern ethical life. He interprets that the modern theories of natural law regard the ethical community as a means for the pursuit of personal interests of individuals or as a coercive system of suppressing individuals. And he criticizes these theories for failing to come up with an idea of the modern ethical life that makes organic and vibrant unification between the ethical community and individuals. He interprets that the main cause of these failures lies in the theoretical method of those theories, 'Abstraction, ' and tries to fundamentally criticize the logical inconsistencies of this method. In this paper, I first reconstructed Hegel's criticism on the empiricist theory of natural law and the formal theory of natural law which he calls the two methods of modern theories of natural law, and then reviewed critically the validity of his criticism. In particular I noted Hegel's criticism on Hobbes’ and Kant's theory of natural law. Consequently I argued that Hegel's criticism is inappropriate to the point of internal criticism, as it is based on misunderstandings of the method of “Abstraction”, without being faithful to the internal logic of those theories.
