본 연구는 ‘상담’을 규정하고 있는 현행법규들을 살펴봄으로써 사회에서 상담을 필요로 하는 영역, 상담서비스에 기대하는 역할과 범위, 상담전문직의 위상을 확인하고, 상담의 전문성과 고유성을 보호받기 위해 향후 어떠한 노력이 필요한지 그 방안을 모색하고자 하는 목적으로 수행되었다. 이를 위해서 법률에서 ‘상담’이 사용되는 영역, ‘심리상담’이 사용되는 영역, ‘심리상담’ 관련 용어의 사용 빈도, 영역별 서비스 제공주체의 종류, 직무, 직위를 구체적으로 살펴보았다. 연구 결과, 첫째, ‘상담’이 언급된 법률 중 약 30% 정도만 ‘심리상담’과 관련된 법으로 확인되었다. 이러한 법률들에서 심리상담은 ‘상담’으로 가장 많이 표현되고 있었다. 둘째, 법률에서 ‘상담’이 사용되는 영역은 장소를 기준으로 가정, 학교, 직장, 군대, 문제의 종류를 기준으로 재난, 재해, 위기, 중독, 범죄, 고용문제, 심리상담이 필요한 대상자를 기준으로 영유아, 아동, 청소년, 노인, 귀화자, 이민자, 장애인, 정신질환자였으며, 이중 범죄, 고용, 학교 영역의 순으로 가장 많이 언급되었다. 셋째, 법률에서 심리상담 서비스를 제공하는 인력으로 언급된 자격 중 사회복지사와 정신건강의학과 의사가 각각 86건, 46건으로 가장 빈번히 언급되고 있었다. 넷째, 심리상담 영역별 서비스 제공주체의 직무를 세부직무별로 구분해서 언급한 법률들에서 상담전문가의 고유 업무인 심리상담 업무를 ‘상담원’이 아닌 ‘임상심리상담원, 심리치료사, 정신보건 임상심리사, 임상심리치료 전문인력’ 등 별도의 인력이 담당하도록 규정하는 것으로 확인되었다. 다섯째, 심리상담 영역별 서비스 제공주체의 직위를 언급한 자격으로 관리자급과 사원급에서 모두 사회복지사업법상의 사회복지사 자격이 가장 빈번히 언급되었다. 마지막으로, 본 연구 결과에 기초하여 논의 및 제언을 제시하였다.

The purposes of this study were to analyze the current laws that define 'counseling', so as to identify the areas needed counseling in society, the expected role and scope of counseling services, and the status of counseling professionals, and to find out what kind of efforts are needed for the future to protect the professionalism and uniqueness of counseling professionals. To do this, the study examined specifically the areas where counseling and psychological counseling is used, the frequency of use of psychological counseling terms, the types, duties and positions of service providers. As a result, first, about 30% of laws mentioned ‘counseling’ were found to refer to 'psychological counseling'. In these laws, ‘psychological counseling’ was most often expressed as ‘counseling’. Second, the areas in which counseling is used in law were based on the place(home, school, work, army); based on the type of the problem(disaster, crisis, addiction, crime, employment problem); based on the types of clients(children, adolescents, elderly people, naturalized persons, immigrants, persons with disabilities and mental illnesses). Among them, crime, employment, and school were the most frequently mentioned in the order. Third, among the workers providing the psychological counseling service specified in the law, social workers and mental health doctors were mentioned most frequently as 86 cases and 46 cases, respectively. Fourth, it has been confirmed that the psychological counseling task, which is a unique task of the counseling specialist, should be charged by separate persons such as clinical psychological counselor, psychotherapist, psychiatric clinical psychologist, and professional clinical psychotherapist in the laws that mentioned separately by detailed job function of the duties of service providers by psychological counseling area. Fifth, qualification of social worker in social welfare business law is most frequently mentioned in managerial level and salary level with reference to the position of service providing subject by psychological counseling area. Finally, discussion and suggestions are presented based on the results of this study.
