동서양의 고금을 불문하고 공공의 국가를 ‘사익 수취의 권력기구’로 주조하는 간신(姦臣)은 정치과정에 실재하는 행위자 가운데 하나이며, 반복적으로 경험하는 사회적 사실이기도 하다. 그럼에도 지금까지 사회사상론, 정치론 등은 천하위공을 내부로부터 잠식해 난세로 전락시키는 간신의 유형, 간신의 행위 동기 및 행위 방식, 그로 인한 사회 병리 현상, 간신의 정치를 바로잡기 위한 통치의 방책 등에 대해 체계를 세워 논리적으로 답하지 못한 것이 사실이다. 그래서 이 글은『한비자(韓非子)』를 간신 문제를 이해할 수 있게 하는 담론 자원으로 새롭게 읽고, 간신 현상을 입체적으로 설명하는 체계적 논리를 제시하려는 것이다. 이런 문제의식에 따른 논구 과정에서 입론한 간신론의 골자는 다음과 같다. 우선, 간신 현상은 도덕 실현의 본연적 가능성으로서 인성(人性)과 인간의 생래적 취약점인 사리사욕(私慾)이 상극(相剋)하면서도 한 시대의 정치의 장에서 상호작용하여 새로운 정치 질서를 생성하는 과정의 산물 이다. 다음으로 간신이란 군주의 뜻에 영합해 신임과 총애를 얻어 권세를 누리고자 하는 자들로 개념 규정한다. 또한 한비자에 따라 실제 정치적 행위자로서 간신을 다섯 유형으로 범주화하고 그들이 간특한 정치어서 간신의 간특한 행위로 국정이 농단될 때 나타나는 사회의 병리적 현상의 주요한 양상과 그 지양 방책을 밝힌다. 그리고 간신 현상을 논구하고 서술하면서 한비자 정치론의 고갱이는 군주는 법을 쥐어 백성에 대한 지배권을 명확히 하고, 술을 통해 신하에 대한 통제권을 확립하며, 세를 가지고 권력자로서 지위를 확실하게 자리매김해야 한다는 것임을 다시 확인한다.

Regardless of all ages and countries, the treacherous subject mould public state as the power mechanism of taking personal benefits. It is one of the actual actors of political process. Also, it is a social fact which is repeatedly experienced. Nevertheless, it is true that social studies and politics have failed to respond logically to the type of the treacherous subject that deteriorate universal justice from the inside of the country to turbulent age, the motivation and methods of their acts, social pathology, and the rule of governance to correct the rule of politics. Therefore, this article aims to shed new lights on Han Fei Tzu as a new discourse resource which allows us to understood the matter of treacherous subject. Moreover, it presents a systematic logic that explains the phenomenon of treacherous subject in many sides. The main principles of the theory of treacherous subject which setting up a theory in accordance with this discussion process are as follows. First of all, the phenomenon is the product of the process which creates a new political order by interacting in the field of politics during an era. Also, it is the incompatibility between personality, which is a proper possibility of human nature and human's inherent weakness, which is the inherent possibility of moral realization. Next, the concept of treacherous subject refers to those who seek authority by acquiring trust and gaining affection in accordance with the will of the monarch. It is also categorized into five types as actual political actors according to Han Fei Tzu. He also revealed the eight types of typical acts which are used when they perform crafty political actions. Moreover, it reveals the major aspects of the pathological phenomenon of society and its preventive measures when the government is monopolized by the crafty act of treacherous subject. In addition, the core political theory of Han Fei Tzu is confirmed again that the ruler should clarify the supremacy to control over the people by the law, establish the control power over the servants by the craft, and strengthen the status as a ruler by the authority.
