오늘날 매년 증가하는 국제이주 추세 속에는 학업을 위해 외국에 가는 학생들의 교육이주도 중요한 부분을 차지하고 있다. 본 연구는 지금까지 연구가 미진했던 국내 중남미국가 출신 동포 유학생의 모국수학 경험을 분석하되, 이들 동포가 국내에서 생활하면서 마주하는 법제적 측면을 중심으로 살펴보고자 한다. 중남미국가에서 성장하여 한국으로 교육이주를 감행한 유학생이, 일반외국인 유학생과는 다른 재외동포라는 특수한 상황에서 한국생활을 하면서 경험하는 일들을, 이들에게 적용되는 한국의 주요 법률들, 특히, 국적법, 병역법, 재외동포법과 연계하여 살펴보았다. 이를 통해 한국의 중요한 잠재적 인적자원인 중남미출신 동포들이 한국 유학에서 겪는 불편을 최소화하고, 중남미국가 동포들의 한국 유학을 활성화 하는 방안을 모색하고자 한다. 주요 연구방법으로는, 현재 서울소재 대학교에서 학부과정이나 대학원과정에 재학 중인 17명의 중남미 출신 1.5세와 2세 한인동포들과의 심층면담을 활용하였다. 조사를 통해 확인한 중남미국가 출신 동포들의 모국수학 경험을 ‘국내대학 입학 과정’, ‘국내에서의 체류자격’과 ‘병역의 의무’로 나누어 법률적 측면에서 고찰해 보았다. 연구분석 결과, 동포차세대들의 한국 유학은 재외동포에게 적용되는 한국의 법제에 적지 않은 영향을 받고 있었다. 동포 학생들이 한국유학에 대해 관심을 가지는 단계부터, 한국행 결정, 한국에서 유학생으로서의 삶, 그리고 유학 종료 이후의 생활에까지 한국의 법제는 동포들의 주요 고려사항이 된다. 현행 국내 법제는 대체로 중남미국가 출신 유학생의 한국유학 감행에 긍정적인 영향을 미치는 것으로 나타났지만, 군입대 문제와 같이 한국국적을 보유한 동포와 외국국적 동포에게 극명한 차이를 가져오는 제도도 있었다. 따라서 우수한 인적자원 확보와 동포사회와의 유대 강화를 기대할 수 있는 중남미국가 출신 동포 유학생의 국내 유치를 고려하면서, 동포 유학생에게 적용되는 법률을 세심하게 검토하는 것이 바람직하겠다.

Education has become one of the most important factors behind the recent growth in international migration. This article explores the understudied experiences of Korean student migrants returning from Latin America, focusing on the legal aspects of their lives in Korea. In particular, the study addresses the implications of legislation such as the Korean Nationality Act, the Korean Military Service Act, and the Overseas Korean Act for this younger-generation diaspora. Using in-depth interview data with seventeen Korean return migrants from Latin America currently enrolled in Korean universities, the article examines their home-coming experiences, particularly involving admission to university, residential status, and obligatory military service. The research findings show that Korean student returnees are significantly influenced by diaspora-related laws, and that they consider the impact of these various laws on their decision-making processes in each stage of their educational migration. This article suggests how difficulties in students’ adjustment processes can be minimized, and how the further influx of Korean diasporas from Latin America can be facilitated. Thus, this article recommends that diaspora-related laws should be attentively reviewed and modified, where necessary, so that South Korea can further accommodate the human resource potential of diasporic youth, and can strengthen its ties with these dispersed communities.
