이 글은 『정신현상학』에서 전개된 헤겔의 『안티고네』 해석을 법철학적인 관점에서 재조명한다. 『안티고네』의 비극은 각각 신적인 법칙과 인간적 법칙, 가족과 정치 공통체, 여성과 남성을 원리적으로 대변하는 조형적 인물들로서 안티고네와 크레온이 일면적으로 자신을 관철하려는 충돌에서 빚어지는 결과이다. 따라서 이 결과는 안티고네뿐만 아니라 크레온에게도 비극으로 나타난다. 그러나 자신의 개별성의 기원을 망각하고 정치 공동체적 보편만을 관철하려는 실정 권력으로서의 크레온에 비해 이에 대항해 인간을 인간 자체로서 인정하려는 자연법적 원리의 수호자로서 안티고네의 인륜적 의식은 더 완전하다. 헤겔은 자연적인 성차에 따라 역할을 할당하는 전통적인 성 역할론을 완전히 벗어나지 못했으나, 『안티고네』의 해석과 이후 법철학적 논의를 통해 궁극적으로 남성과 여성의 합일, 인간적 법칙과 신적인 법칙의 통일이 인륜적 공동체 전체의 활동적 중심(Mitte)을 형성해야 한다고 본다.

This article sheds new light on Hegel’s interpretation of Antigone in the Phenomenology of Mind from law-philosophical viewpoint. The tragedy of Antigone results from the collison of the divine law and the human law, family and political community, woman’s and man’s principle which Antigone and Kreon as plastic characters will respectively represent and onesidedly accomplish. Therefore, the result appears not only as tragic to Antigone but also to Kreon. But compared with Kreon as bearer of positive power who forgets his origin of individuality and accomplishs only the universal of political community, the ethical consciousness(das sittliche Bewusstsein) of Antigone who will, as defender of the principle of natural law, recognize human being in itself, is more perfect. Although not completely overcome the traditional role theory of sexuality on the basis of natural sexual differences, Hegel by his interpretation of Antigone and later law-philosophical delibrations deems that the unification of man’s and woman’s principle, the unity of the human law and the divine law should ultimately make up the active middle of ethical community(sittliche Gemeinschaft) all over.
