개인의 자유를 정부가 자의적으로 억압하는 것은 공화주의의 기본정신과 충돌한다. 그러나 역사적으로 보면, 자유에 대한 가장 심각한 위협은 독재 권력과 정부다. 그래서 공화주의자들은 정부에 의한 ‘자의적’ 억압으로부터의 해방을 강조한다. 그러나 지금도 정부와 정책의 자의성을 견제하는 것은 여전히 쉽지 않다. 국민들의 생각이 분열되어 있어 정책의 자의성을 판단할 기준의 수립이 어렵다. 정책의 과정 역시 자의성을 견제할 공통목적이나 공감을 탐색하는 과정이 아니라 정치적 이익과 관료적 지배를 강화하는 장치로 전락할 수 있다. 민주적 과정에 의한 자의성의 견제가 쉽지 않은 원인으로 이 연구는 정책 언어와 사고의 자의성 문제와 이를 정치적 또는 조직적 이익을 위해 이용하는 정치인과 관료의 행태에 주목하고 있다. 개념은 보편적이고 공통적인 의미의 근거를 가질 때 제대로 작동한다. 그런데 개인, 기업, 대학 등 정책대상은 각자가 처한 상황과 여건에 각자의 방법으로 대응하며 생존하는 개별성과 실존적 속성을 보유하고 있다. 개념으로 담아낼 공통 속성의 매우 제한적이다. 그럼에도 선거와 정책적 편의를 위해 추상적 개념과 자의적 사상으로 정책을 포장하면서, 정책과 현실의 괴리 문제와 더불어 언어적으로는 화려하나 실상은 자의적인 억압이 정당화되는 문제가 발생한다. 이 연구는 대학평가에 대한 사례연구를 통해 정책을 위해 동원한 개념이 현실과 괴리되면서 교육부에 의한 자의적 억압의 정당화 도구로 전락했음을 보여주고 있다. 최저임금, 근로시간, 비정규직 등의 문제를 놓고 겪고 있는 혼란도 복잡한 문제를 특정 개념과 이념에 기초해 단순화하면서 현상의 실상과 정책이 괴리되었기 때문임을 시사하고 있다. 추상적이고 화려한 언어가 아니라 정책당사자의 의견을 중시하는 것이 정책을 매개로 한 자의적 억압의 차단에 유용함을 시사하고 있다.

The arbitrary control of individual liberty undermines the basic rule of democratic governance. The most dominating threats of individual liberties over human history, however, were also the despotic power holders and their governments. This is the reason why republican thinkers stressed free from the arbitrary power to protect individual liberty. Checking arbitrary power, however, seems not an easy goal. Divided public interests hinders to build a public value that will become the scale to judge the arbitrariness of policy. Policy process can also work not as a process of forging common goal to check arbitrariness of policy but as a tool to serve for the special political interests. This study examines the contingencies of the meaning of words to identify the epistemological origin of arbitrary control by government policy. Concepts work as the describing media when they stand for the general and common properties. If the signified objects are existential realities which can be characterized individual uniqueness, the concepts lose the ground to build common meaning. Without concrete and common meaning referent, government policy gives an opportunity for highly contingent words and one-sided ideal words to penetrate into the policy. Under these circumstances, government policy falls into a tool of arbitrary control.
