최근 각국의 규제개혁과정에서 규제사후영향평가제도가 적극적으로 강조되고 있다. 본 연구는 향후 우리나라의 규제사후영향평가 도입 과정에서 어떠한 개념적 이해를 바탕으로 제도설계를 추진할 것인지를 논의하고자 한다. 현재 사전적 규제영향분석제도를 운영하고 있는 상황에서 제도 참여자인 공무원의 인식수준을 바탕으로 두 제도 간에 대체적 혹은 보완적 관계를 실증적으로 확인하고자 하였다. 분석 결과, 사전적 규제영향분석제도의 효과성에 대한 긍정적 인식을 바탕으로 규제사후영향평가제도의 필요성을 강조하는 보완적 차원에서의 접근이 주요하게 나타나고 있음을 확인하였다. 물론 현행 사전적 규제영향분석제도의 운영이 규제개혁에 긍정적이라기보다는 부정적이라는 인식도 일부 확인할 수 있어 대체적 관계의 가능성도 제기될 수 있다. 그럼에도 불구하고, 전반적인 분석결과에서는 사전적 규제영향분석의 한계점으로 인해 규제사후영향평가를 지지하기 보다는 규제영향분석의 효과성에 대한 신뢰가 규제사후영향평가의 필요성과 연계되고 있다는 점에서 두 제도 간의 보완적 관계를 확인할 수 있다.

In recent years, ex-post regulatory impact analysis has been actively emphasized in the process of regulatory reform. This study intends to discuss what kind of conceptual understanding of the ex-post regulatory impact analysis should be pursued in Korea. For this, considering the current regulatory impact analysis system, I made an empirical approach by identifying the substitutional or complementary relationship between the ex-ante and the ex-post regulatory impact analysis based on the level of awareness of public officials. As a result of the analysis, it can be concluded that the complementary approach between them is dominant emphasizing the necessity of the ex-post impact analysis based on the recognition of positive effects of the ex-ante impact analysis. Though there is a little negative recognition on the current ex-ante impact analysis system, it is possible to confirm that most public officials support adopting the ex-post impact analysis because of the confidence rather than the disappointment in the effectiveness of the ex-ante impact analysis.
