필자는 우리나라 외국환거래법의 시원을 추적하였다. 그 결과, 지금까지 알려진 것과는 다르게, 우리나라 외국환거래법의 효시는 1946년에 미군정이 발한 대외무역규칙이 아니라 1933. 5. 1. 일제가 당시 식민지 조선에 시행한 외국환관리법임을 확인할 수 있었다. 지금으로부터 무려 85년 전인 1933년에 지금의 외국환거래법과 별반 다를 것이 없는 법이 이 땅에 시행되었다는 사실은 필자에겐 큰 충격이었다. 이에 1933년에 일본이 만든 외국환관리법을 전문 번역하여 소개하기로 하고, 이와 아울러 이 법의 입법배경, 주요내용을 조사하여 정리하였다. 그리고 동 시대에 형성되었고 세계 최초라고 알려진 독일의 외환통제시스템의 내용과 생성배경, 그리고 일본의 법이 독일로부터 영향을 받았는지까지 분석하였다. 우리나라 외국환거래법은 난해하기로 유명한데, 필자는 오래 전부터 그 원인이 우리가 이 법의 입법취지를 모르기 때문이라고 생각해 왔고 항상 그것을 궁금해 해왔다. 그런데 이번에 외국환거래법의 진짜 효시를 알게 되었고 드디어 그 입법배경을 파악할 수 있게 되었다.

I traced the origin of the Korean Foreign Exchange Control Law. Unlike what has been known as the origin until now, the "Foreign Trade Decree" promulgated by U.S. Commander in 1946, I found that the real origin is "Foreign Exchange Control Law" enforced by Imperial Japan in the colonized Korean peninsula in 1933. I was surprised that even 85 years ago from now, the very similar law with the current Korean Foreign Exchange Control Law was enacted and implemented in this land. Thus, I decided to translate and introduce the full text of the 1933 Japan made Law. In addition to, I researched the background of the Japan legislation and summarized the principle content of the law. Along with Japan law, I researched also Deutsch's Exchange Control System which was made in contemporary age and was known as the first foreign exchange control policy in the world. I also analyzed whether the Japan legislation was influenced by Deutsch legislation. The Korean Foreign Exchange Law is notorious for difficulty to understand, and I always think that the reason is because we don't know the background of the legislation and I have been curious about that. Then, now I became to know the correct origin of the law, and finally can figure out the background of legislation.
