회복적 사법(justice restaurative)은 특정 범죄의 당사자 및 여타 이해관계자들이 함께 모여 범죄로 인해 야기된 피해의 회복 방안을 건설적으로 논의하는 과정으로 이해할 수 있다.
회복적 사법의 적용범위(Champ de l’application)의 문제, 즉 어떤 범죄에 회복적 사법 프로그램을 적용할 것인가의 문제는 프로그램의 유형, 프로그램과 기존의 형사절차와의 연계 방식, 현실적 여건 등에 의해 결정된다.
회복적 사법의 대표적인 실천 프로그램으로는 조정(mediations), 회합(conferences), 써클(circles) 세 가지이며, 전 세계적으로 이 프로그램들은 주로 기소 이전 단계에서 소년과 성인에 의한 재산범죄, 폭행 등 개인적 법익에 관한 범죄에 적용되어 왔으며, 이는 우리나라의 경우에도 마찬가지이다.
원론적인 차원에서 볼 때 회복적 사법이 개인적 법익침해 범죄에 한정될 이유는 없다고 회복적 사법의 지지자들은 주장하고 있다. 회복적 사법의 주된 관심은 기존의 형사사법시스템과는 달리 추상적인 법익 보호가 아니라 범죄로 인해 발생한 피해의 회복이다. 그러므로 회복적 사법은 법익의 종류에 따라서 그 적용의 가부에 차이가 있는 것이 아니라, 사회적·국가적 법익에 관한 범죄의 경우에도 적용될 수 있다고 보아야 한다.
외국의 경우, 사회적 혹은 국가적 법익에 관한 범죄에 회복적 사법 프로그램을 적용하고 있는 사례가 있다. 대표적인 것이 바로 프랑스에서 시행되고 있는 환경범죄(infractions en matière environmentale) 분야에서의 형사조정(mediation penale), 즉 환경형사조정(mediations penales environmentales)이 그것이다. 본 연구에서는 프랑스의 환경형사조정의 내용을 소개하고 이 제도가 우리에게 갖는 시사점을 도출하고자 한다.
Restorative justice can be understood as a process of discussing constructively the ways in which the victims of certain crimes and other stakeholders come together to restore the damage caused by the crime.
The problem of the scope of restorative justice, ie, the application of a restorative justice program to an offense, is determined by the type of program, the linkage between the program and the existing criminal procedure, and the realistic circumstances.
There are three main practices of restorative justice: mediations, conferences and circles. Globally, these programs are primarily applied to crimes related to personal and legal interests such as property crime and assault by youths and adults in the pre-prosecution phase This is also the case in South Korea.
From a theoretical point of view, supporters of the restorative justice argue that there is no reason why restorative justice is limited to personal infringement. Unlike the existing criminal justice system, the main concern of restorative justice is not the protection of abstract legal interests but the restoring of the damage caused by crime. Therefore, restorative justice should be seen not only in terms of the applicability of the application, but also in the case of crimes related to social and national interests.
In the case of foreign countries, there are cases where restorative justice programs are applied to crimes related to social or national legal interests. A typical example is the penal mediation in the field of environmental crime in France. The purpose of this study is to introduce the contents of environmental penal mediation in France and to draw some implications of this system for South Korean practice of penal mediation.
