본 연구는 불법체류자 관리를 위한 적극적인 정부정책이 필요한 시기에 가용한 정책도구의 목록을 작성하고, 사용되지 못한 정책도구의 가능성을 검토하기 위하여 일본의 정책수단을 검토하였다. 일본은 불법체류자의 관리에 있어서 불법체류자 반감정책을 성공적으로 수행하고, 그 이후에도 지속적으로 불법체류자문제에 대한 다양한 정책수단을 활용하여, 불법체류자를 6만명 수준으로 유지하고 있다. 불법체류와 관련해서 정책목표의 모호성과 이에 따른 일관되고 지속적인 정책수단의 활용이 제한적인 한국으로서는 매우 효과있는 벤치마크가 될 수 있다고 판단한다. 이를 위해 본연구는 일본정부가 활용한 정책수단을 Hood의 분류에 따라 정보형 정책수단, 강제적 정책수단, 조직 정책수단, 재정적 정책수단 등을 검토하였다. 기본적으로 한국보다 정책수단의 다양성과 활용범위면에서 차이가 있다고 판단된다. 향후 한국이 불법체류문제에 대해 적극적인 정책목표를 설정하고, 효과적인 정책수단의 조합을 고려할 때 활용할 수 있는 대안목록으로 의미가 있을 것이다.

If Korea considers the combination of effective policy tools by setting positive policy targets on the issue of illegal stay in the future, The alternative list that can be used is meaningful.
