금융시스템의 하부구조로서 지급결제시스템의 중요성은 지급결제제도에 대한 충격이 금융제도 전체로 확산되어 경제 전반이 마비될 수 있다는데 있다. 이러한 이유 때문에 지급결제시스템에서는 안정성이 특히 강조되고 있는데 지급결제시스템 감시(oversight)는 지급결제시스템의 안정성 유지에 핵심적인 역할을 하고 있다. 우리나라는 2009년 자본시장통합법의 시행을 계기로 증권사는 “조건 없이” 소액결제시스템 참가자로서의 법적 지위를 얻게 되는데 이에 따라 지급결제시스템의 안정성 저하를 방지하기 위해 감시를 포함한 제도의 정비가 필요하다. 특히 현재 제도에서 미흡한 참가자에 대한 적격성 기준을 해외사례에서 보는 바와 같이 명시적으로 설정할 필요가 있다. 이를 위해서는 지급결제법의 도입에 대한 논의를 서두를 필요가 있다.
This paper is concerned with some legal uncertainty on the oversight function of BOK under the changing legal environments. The Capital Market Consolidation Act (CMCA) that will be in effective since 2009 allows security firms to take legal positions as direct participants into Korean Retail Payment System without eligibility standard for the participation. However, the law does not explicitly deal with the issue of oversight function of BOK even though the participation of security firms will create controversies regarding the issues. With the new act, BOK may face two possibilities: either to become stronger or to become weaker in the supervisory function as well as the oversight function. This implies that some safety concerns on the Retail Payment System may take place if the uncertainty is not appropriately dealt with. We suggest that the issue should be seriously discussed to produce desirable results with well-founded legal basis.
