범죄 예방 및 수사에 드론을 활용하는 것이 필연적이고 범죄로부터 국민을 보호하는데 보다 더 효과적이라면 선제적으로 법과 제도가 드론의 허용 범위와 요건을 마련해야 한다. 특히, 범죄예방과 수사에 있어서는 더욱더 엄격한 허용요건을 마련하여, 드론 사용으로 인하여 발생할 수 있는 국민의 기본권 침해나 남용을 최소화해야 한다. 지나치게 활용의 필요성에 초점을 맞춰 무분별하게 허용하거나 활용범위를 확대한다면 국민의 기본권은 침해될 수밖에 없다. 즉 수사의 효율성과 헌법상의 국민의 기본권을 조화시킬 수 있는 허용 범위와 요건이 마련되었을 때 법의 테두리 범위 내에서 다양한 활용 방안이 마련될 수 있다. 본 논문에서는 국내외 드론 활용 논의를 분석하여 법적 허용 범위와 요건을 연구하였다. 드론 활용의 법적 성격을 규명하고, 기존의 경찰작용과 형사사법 체계안에서 이를 새로이 해석하여 허용 범위를 제시하였다. 나아가 드론 사용의 오남용을 방지할 수 있는 방안을 마련함에 있어서 현행 법체계가 갖는 문제점을 분석하고, 세부적인 허용 요건을 제시하였다. 드론 활용을 통하여 사회의 안녕과 질서를 지금보다 더 높은 수준에서 유지할 수 있고, 신속한 범죄자 검거를 통해 실체적 진실발견에 기여할 수 있다면, 법적으로 허용 가능한 범위 안에서 활용 방안이 연구되어져야 한다. 그렇기 위해서는 드론의 허용 범위와 요건을 법률상으로 명확히 규정하고, 오남용에 대한 통제시스템을 마련해야 한다.

The use of drones in crime prevention and investigation is inevitable. Acts should preemptively establish the permissible range and requirements. In particular, stricter requirements should be prepared for criminal procedure laws. The violation of the basic rights of the people that may arise from the use of drones should be minimized. If the government focuses too much on the need to utilize the technology, the basic rights of the people will be violated. There should be an acceptable scope and requirements to harmonize the efficiency of investigations with the basic rights of the Constitution. Within that scope, a variety of measures can be found. In this paper, the discussion of the utilization of drones at home and abroad has been analyzed and the legal permissible range and requirements have been studied. The legal nature of using drones was identified and interpreted in the existing police action and criminal procedure law system. On the basis of these interpretations, the permissible ranges are presented. Furthermore, a measure was taken to prevent misuse of drones. The problems of the current legal system are analyzed and detailed acceptance requirements are presented.
