판 빠레이스는 ‘자원에 대한 권한의 정의로운 분배’라는 관점에서도 분배정의를 논의한다. 또한 이를 실질적 자유지상주의 이념에 기초하는 분배정의, 곧 ‘실질적 자유의 최소극대화’ 및 이를 위한 기본소득정책과 통합한다. 이 글은 이러한 과정에 대한 비판적 재구성으로 다음과 같이 진행된다. 첫째, 판 빠레이스가 실질적 자유지상주의 이념에 기초하는 분배정의와 자신의 권한이론적 관점에 기초하는 분배정의, 곧 ‘자원에 대한 권한의 정의로운 분배’를 통합하는 과정을 비판적으로 재구성한다. 그 결과 한편에서는 그가 기본소득을 분배정의로서, ‘호혜성으로서의 정의’와 근본적으로 구분함을 보인다. 다른 한편 실질적 자유지상주의 이념에 기초하는 분배정의가, 권한이론적 관점에서는, 물려받는 공유지에 대한 모두의 공유 권한에 근거하여 정당화됨을 보인다. 또한 이런 맥락에서 실질적 자유지상주의를 통해 자유주의적 평등주의와 공유주의가 통합됨을 보인다. 둘째, 이러한 비판적 재구성에 기초하여, 한편에서는, 새로운 공유지의 생산과 관련되는 모두의 직간접적 노력 또한 기본소득에 대한 권한의 근거임을 주장한다. 즉 이 경우 호혜성으로서의 정의, 특히 협동적 정의가 기본소득에 대한 권한의 또 다른 근거가 된다고 주장한다. 다른 한편, ‘실질적 자유의 최소극대화’가 독립적인 분배정의원칙이 아니라 기본소득의 크기를 규정하는 원칙임을 보인다. 또한 이런 맥락에서 실질적 자유지상주의를 공유주의 분배정의론의 한 유형, 곧 자유주의적 평등주의 유형의 하나로 제시한다.

Van Parijs also discusses distributive justice in terms of 'just distribution of entitlements to resources'. He also integrates this with the distributive justice based on the ideal of real libertarianism, i.e., the maximin of real freedom and the basic income policy for its implementation. This paper is a critical reconstruction of this process. The research in this paper proceeds as follows. First, this paper critically reconstructs Van Parijs' process of incorporating a distributive justice based on the ideal of real libertarianism and a distributive justice based on his entitlement theory of justice which argues just distribution of entitlement to resources. As a result, this paper shows that he basically distinguishes basic income as a distributive justice from ‘justice as reciprocity’. On the other hand, this paper shows that the distributive justice based on the ideal of real libertarianism is justified based on the entitlement to sharing of inherited commons, in terms of entitlement theory. In this context, this paper also shows that liberal-egalitarianism and commonism are integrated through real libertarianism. Second, based on this critical reconstruction, this paper, on the one hand, argues that direct and indirect efforts by everyone involved in the production of new commons are also the basis for the entitlement to basic income. In other words, this paper argues that in this case justice as reciprocity, especially cooperative justice, is another basis for entitlement of basic income. On the other hand, this paper shows that 'maximin of real freedom' is not an independent principle of distributive justice but a principle that defines the size of basic income. In this context, this paper also presents the real libertarianism as a type of commonist distributive justice, a liberal-egalitarian type.
