중소기업 및 소상공인의 사업영역을 보호하기 위하여 고유업종제도, 사업조정 제도, 중소기업 적합업종제도를 도입하였으나, 고유업종제도는 폐지되었고, 사업조정제도와 중소기업 적합업종제도는 부작용 문제가 제기되고 있다. 이러한 기존 제도들의 문제점을 보완하고 영세 소상공인을 보호하기 위하여 생계형 적합업종제도가 도입되어 운영되고 있다. 본 논문에서는 그간에 운영된 제도의 도입배경, 주요내용, 부작용 등을 검토하고, 생계형 적합업종제도와 비교하여 생계형 적합업종제도 운영과정에서 발생할 수 있는 부작용을 최소화하는 방안과 중ㆍ소상공인의 경쟁력 강화 방안을 연구하였다. 중소기업 및 소상공인은 우리 경제에서 큰 비중을 차지하고 있는 만큼, 이들의 사업영역 보호 및 경쟁력 강화의 필요성을 인식할 필요가 있다. 기존 제도들을 통해 중소기업의 사업영역을 보호하고 이들의 경쟁력을 강화하기 위한 노력이 지속되고 있으나, 생계형 적합업종제도를 통해 기존 제도들의 부작용을 인식하고 중ㆍ소상공인의 사업영역을 보호하는 동시에 이들이 경쟁력을 강화하여 자생력을 갖출 수 있도록 지원하는 것이 무엇보다 중요하다고 볼 수 있다. 생계형 적합업종제도가 기존 제도들의 문제점을 보완하고 안착하기 위해서 두 가지 방안을 제안하였다. 첫째, 객관적이고 합리적인 실태조사 체계 구축, 둘째, 단순 보호에 그치는 것이 아니라 보호와 동시에 자생력을 갖출 수 있도록 체계적인 경쟁력 강화 지원 방안을 수립하는 것이다.

In order to protect the business areas of small and medium-sized businesses, Korea has adopted a designation of distinct business for SMEs system, a business adjustment system, and a suitable business for SMEs system. However, a designation of distinct business for SMEs system was abolished and the problem of side effects of a business adjustment system and a suitable business for SMEs system was pointed out. In order to overcome the problems of these existing systems and to protect the small and midsize business man, designation suitable business for small businessman system has been introduced and operated. This study review the introduction background, main contents, and side effects of the system operated in the past. Compared with the designation suitable business for small businessman system, I propose to minimize the side effects that could occur in the operation of the designation suitable business for small businessman system and to enhance the competitiveness of small businessman. As SMEs and small businesses are great part of our economy, it is necessity that their business field protection and competitiveness reinforcement are recognized. Although the existing systems are protecting the business fields of SMEs and sustaining their efforts to reinforce their competitiveness, it can be seen that enabling them to reinforce competitiveness and become self-perpetuating is far more important, while recognizing the side effects of the existing systems and protecting the business fields of small businesses through the system suitable for working businesses. In order to complement and settle the problems of existing systems, two types of schemes were suggested. First, it establishes an objective and reasonable surveillance system. Second, it establishes a plan to strengthen systematical competitiveness so that it can provide protection and self-sufficiency at the same time.
