성년후견제도와 사회복지제도는 목적이 유사한 원리와 가치를 지향하며, 그 대상도 어느 정도 일치한다. 무엇보다 성년후견제도가 가족제도를 벗어나 국가의 사법복지제도로서의 기능을 하고 있다는 점에서 양제도의 접점이 있다고 할 수 있다. 현대사회에서 가족의 역할은 점차 쇠퇴되고 있으며，국가로 하여금 가족의 자리를 점점 대신하고 있다. 즉，과거의 가족은 가족 내 치매노인이 있을 경우 그를 대신해 가족의 구성원 중 일부가 의사결정을 지원하고, 요양 등의 일상생활의 지원을 해 왔으며, 가족과 함께 주거지 내에서 생활을 영위하여 왔다. 이에 반해 현대에 와서는 산업화，도시화의 영향으로 핵가족화가 이루어졌으며，부양기능의 약화로 요지원자의 일상생활은 더 이상 가족의 책임 하에 이루어질 수 없게 되었다. 이에 후 견인을 선임함으로써 치매노인이 가족의 도움 없이도 사회적 삶을 유지하고，사회의 구성원으로서 참여를 하는데 있어서 제도적 밑받침이 되는 성년후견제도의 역할이 부각되었다. 그러나 여전히 대부분의 사회복지 관련 법률에서는 성년후견제도를 제대로 이해하고 있지 못하고 있으며，이로 인해 사회복지제도로서 자리매김하는데 많은 한계를 보이고 있다. 실질적인 피후견인의 자율성과 정상화를 보장하기 위해서는 제도적 장치의 마련과 더불어 사회복지제도와의 실효성 있는 연계방안이 마련되어야 할 것인 바, 본 논문에서는 성년후견제도가 사회복지제도로서 보다 활발하게 이용될 수 있도록 실질적 연계방안을 모색하고 있다. 그럼으로써 사회복지 패러다임의 변화와 고령사회에 대응함과 동시에 사회복지제도로서 건전한 형태로 그 기능을 발휘하는데 기여하고자 한다.
Adult guardianship system and social welfare system pursue similar principles and values in terms of purpose, and their subjects are similar. Most of all, both systems reach agreement in the point that adult guardianship system goes beyond family system and serves as social welfare system of a state. In todays society, the roles of families gradually shrink, and a state stands in for families. In other words, in the past, if a family had an elderly person with dementia, some of family members made a decision, supported activities of daily living for the dementia patient, like caring, and lived together, With the industrialization and urbanization, there have been more nuclear families. With the weakening function, of support, activities of daily living for persons who need to be cared for have not been under family’s responsibilities any more. In the circumstance, emerged has been the ides of adult guardianship system in which elderly persons with dementia can live their social life with no help of their family and can become a social member by selecting a guardian. However, most social welfare laws fail to understand adult guardianship system properly, and thereby there are many limitations in order for adult guardianship system to constitute social welfare system. To guarantee practical autonomy and normalization of wards, it is necessary to come up with an institutional system and an. effective plan to connect with social welfare system. Therefore, this study tries to find a practical connection method in order for adult guardianship system to be used as social welfare system more actively. The method is expected to respond to the changing social welfare paradigm and the ageing society and to contribute to fulfilling its good function as social welfare system.
