본 연구는 소송당사자가 사망한 경우 상속인에게 소송수계, 상소 등을 적극적으로 허용함으로써 해당 소송절차 안에서의 충분한 소송수행권을 보장하고, 이로써 단일절차 내에서 분쟁을 해결할 수 있는 길을 열어주는 것이 절차적 정의와 소송경제에 부합한다는 취지에서 그 가능성을 모색하고, 그와 관련하여 별도의 절차인 재심청구는 어느 범위에서 허용될 수 있을 것인지를 구체적으로 살펴보는 데에 목적이 있다.
먼저 원고가 소장부본 송달 전에 사망한 자를 피고로 기재한 소장을 제출하여 소를 제기한 경우, (1)원고에 의한 당사자표시정정 외에도 피고에 의한 소송수계도 허용할 필요가 있고, (2)상속인이 소장부본을 송달받았다면 일단 그 판결의 효력은 상속인에게 미치는 것으로 보되, 상속인에 대한 절차권의 충분한 보장을 위하여 상소(추완)의 기회를 충분히 제공할 필요가 있으며, (3)당사자 사망을 간과한 판결을 무효로 보는 경우에도 그에 대한 상소를 일반적으로 허용할 필요가 있지만, (4)위와 같이 소송수계와 상소를 통한 소송수행권 보장이 충분히 이루어지는 이상, 보충적 구제수단이자 별도의 절차인 재심은 허용할 필요가 없다고 본다.
소장부본 송달 후 당사자가 사망한 경우, (1)판결결과 귀속을 정당화할 수 있을 정도로 상속인에게 상소권 등 소송수행권을 충분히 보장하기 위하여서는 판결정본이 상속인에게 실질적으로 송달되지 않는 한 판결이 확정되는 것으로 보아서는 안되고, (2)당사자에게 소송수행권이 실질적으로 보장되었다면 재심을 허용할 필요가 없으므로 재심청구를 허용할 수 있는 상황은 매우 제한적인바, 상고인(또는 피상고인)이 상고이유서(또는 답변서) 제출기간 도과 전에 그 제출 없이 사망하였음에도 상고심 법원이 그 사망사실을 간과한 채 상고기각 판결(또는 상고인용 후 파기자판)을 한 경우로 한정되어야 할 것으로 본다.
If a plaintiff institute a lawsuit against a defendant who had already died, or the defendant dies before the complaint is delivered to the defendant(from this time the lawsuit is pending), the procedure is illegal(unqualified). In this case, according to The Supreme Court, the plaintiff can correct the party(defendant) with the successor, who is the real party, but the successor can not success the procedure; if the court dosen’t realize the defendant is dead and pronounce a judgement, the judgement is ineffective, accordingly the appeal and retrial is not permitted.
But as an present writer’s suggestion, the successor can success the proceedings, and file an appeal, in order to settle the dispute in single procedure; economic procedure.
If a party dies while an action is pending, the proceedings are interrupted and his status as a party is succeeded by his successor. In this case, if the court overlooks the death of party and pronounces a judgement, it is effective to successor (including the effect of res judica, after being decided), accordingly the appeal is permitted. According to The Supreme Court, in this case, the successor can file the retrial.
But the retrial is exceptional and extraordinary solution, so in the case that the party has the adequate procedural chance in the procedure-including the appeal, the retrial should not be permitted. In conclusion, when a party dies after making a final appeal, but before expiry of the term for a statement of grounds of the final appeal, if the court dismisses the final appeal, immediately the judgement become conclusive, so in this case the successor of the party deceased is permitted to make the retrial. Equally when the other party dies during the proceeding of final appeal, before expiry of the term for a written answer, if the final appeal results in favor of the appellant and immediately the judgement become conclusive, in this case the successor of the party deceased is permitted to make the retrial.
