에콰도르 헌법상 자연의 권리, 그 이상과 현실

1972년 스톤(Christopher Stone) 교수는 “나무도 원고적격을 가져야 하는가?”라는 글을 통해 자연물(natural objects)에도 법적권리를 인정할 수 있음을 설득력 있게 논증하였다. 그러나, 실제 자연물이 당사자가 된 소송에서 자연물에 사실상 권리주체성을 인정한 법정은 없었다. 2008년 9월 에콰도르는 자연의 권리 조항을 담은 헌법개정안을 국민투표로 통과시킴으로써 헌법에서 자연의 권리를 인정한 첫 번째 나라가 되었다. 헌법 제71조는 “생명이 재창조되고 존재하는 곳인 자연 또는 파차마마(Pachamama)는 존재와 생명의 순환과 구조, 기능 및 진화 과정을 유지하고 재생을 존중받을 불가결한 권리를 가진다. 모든 개인과 공동체, 인민과 민족은 당국에 청원을 통해 자연의 권리를 집행할 수 있다.”고 한다. 2011년 에콰도르 법원은 처음으로 자연의 권리 조항을 인용하여 환경영향평가를 하지 않고 도로 건설과정에서 발생한 폐기물을 하천에 버린 지방정부를 상대로 강과 주변 생태계의 원상회복을 구한 원고의 청구를 받아들였다. 그러나 자연의 권리 조항이 언제나 헌법의 본래 취지에 따라 해석, 적용되는 것은 아니다. 대표적으로 콘도르-미라도르(Condor-Mirador) 노천 채광개발 사건에서 법원은 채광개발사업은 ‘보호지역’에 영향을 미치지 않고, 공익에 해당하는 광산 개발이익이 사적 목적에 해당하는 시민사회의 자연보호 노력에 우선하므로 이 사건에서 환경 훼손은 자연의 권리 조항을 위반한 것은 아니라고 판시하였다. 자연의 권리 조항에 따라 제기된 소송 중 원고가 승소한 것도 패소한 것도 있다. 이러한 소송결과는 겉으로는 자연의 권리 조항의 해석, 적용을 둘러싼 다툼의 결론으로 보이지만, 그러한 해석, 적용에는 에콰도르의 정치경제적 개발구조와 기득이익집단의 세력, 사법부의 독립성, 법률가들의 자연의 권리에 관한 법적 소양 등 여러 다양한 변수들이 영향을 미친다. 그럼에도 자연의 권리가 법원에서 받아들여진 것은 자연의 권리가 실제 현실에서 정상성(normalcy)을 획득하는 과정으로 볼 수 있다. 자연의 권리가 지금은 약하지만 자연적 실체를 사람과 같은 것으로 보는 방식으로 더 강해질 수 있을 것이고, 그럴 때 자연의 권리는 단순한 립-서비스에서 비중을 갖는 그 무엇으로 바뀔 것이다. 여기서 특히 중요한 것은 자연적 실체의 법적 보호를 지지하는 정치적 의지의 향방이다.

In September 2008, Ecuador became the first country in the world to recognize the rights of nature as a constitutional right by passing a constitutional amendment containing the provisions of nature's rights by referendum. The article 71 of the Constitution states that “Nature, or Pacha Mama, where life is reproduced and occurs, has the right to integral respect for its existence and for the maintenance and regeneration of its life cycles, structure, functions and evolutionary processes. All persons, communities, peoples and nations can call upon public authorities to enforce the rights of nature. To enforce and interpret these rights, the principles set forth in the Constitution shall be observed, as appropriate.” In 2011, the Ecuadorian court favored a plaintiff's claim to restore rivers and its surrounding ecosystems against local government, who did not conduct environmental impact assessments before dumping the waste generated in the road construction process into rivers. However, the provisions of the rights of nature are not always interpreted and applied following the original purpose of the Constitution. Some of the lawsuits filed under the provisions of the rights of nature have prevailed or the others have not. The results of the litigation seem to be the conclusions of the dispute over the interpretation and application of the provisions of natural rights, but such interpretation and application are related to the political and economic development structure of Ecuador, the forces of the interest group, the independence of the judiciary, and lawyers’legal literacy on the rights of nature. Despite these failings, in Ecuador the rights of nature do seem to be deepening and developing. While rights of nature arguments have won in only a few cases, and never against large extractive concerns, these few cases evince a growing normalcy in actual, practical care for the rights of nature. These rights are weak currently but will likely become stronger, in a way that makes natural entities more legitimately person-like, as they become implicitly normed in law, moving the rights of nature from lip-service to something with heft. What matters here is the tenor of the political will supporting legal protections of these entities.
