연구에서는 중국이 무역자유화 촉진정책으로 자유무역시험구 지정을 적극적으로 확대하고 있다. 이 과정에서 자유무역시험구 내 침해물품 거래량의 증가는 지식재산권 침해를 초래하고 있다. 따라서 중국 정부 및 기업의 지식재산권 강화 및 관련 보호법률제도의 변화 등 환경변화에 신속하게 대응해야 한다. 그러나 중국 내 우리기업의 지재권 침해피해와 분쟁이 지속적으로 증가하지만 이에 대한 대응 및 관리능력은 미흡하다. 따라서 중국 자유무역시험구 내 지식재산권을 침해하는 물품에 대한 세관보호조치가 어떻게 이행되고 있는지 관련 법률검토를 통해서 검토해 보고 이에 대한 시사점을 제시하고자 한다.

The pilot free trade zone is a special region within the territory in China. The border protection of intellectual property right has important for domestic commodity market order. China is creating a ‘1 + 3 + 7’ free trade zone model, combining the resources of each region and leading the Free Trade Zone of China 3.0. However, there is no clear explicit rule on the supervision and enforcement of intellectual property rights on international cargo in China’s pilot free trade. Increasing volumes of goods in China’s free trade zones have led to sudden increases in cross-border intellectual property disputes. The increase in the volume of international cargo through China may also encourage the illegal act of cargo. In other words, This is the issue of customs intellectual property enforcement of goods infringing intellectual property rights in the Free Trade Zone. Therefore, the problem of border protection of intellectual property rights has become a pressing matter of the moment. As the international trade environment of the free trade area changes, China should take more stringent law enforcement measures to protect the intellectual property rights of free trade zones.
