이 글은 『철학사 강의』에서 헤겔이 제시한 소크라테스의 죽음에 대한 해석을 법철학적 관점에서 재조명한다.
헤겔에게 소크라테스의 죽음은 단순한 개인적 비극이 아니라 고대 인륜성의 모순이 한 철학자의 비극적 운명 형태로 표출된 세계사적 사건이다. 여기서는 내적으로 보편적 개체성에 도달하려는 주관적 자유의 자기 의식적 원리와 얽매임 없이 신의 외적인 명령에 의존해 살아가려는 인륜성의 순박한 원리가 충돌하고 있다. 다시 말해 자연법적인 비판적 사유와 실정법적인 일상의 인륜이 소크라테스의 철학과 삶 전반에서 충돌하고 있으며, 바로 이 충돌이 그에 대한 소송과 사형집행 과정에서 첨예화되었된 것이다. 이러한 충돌과 갈등은 이미 아테네 민족의 삶 자체 내에도 무의식적으로 자리잡고 있었다. 따라서 소크라테스의 사형을 통해 아테네 민족은 인륜적 보편성을 요구하는 바로 자기 자신의 새로운 원리를 제거한 셈이다.
그리고 바로 그 때문에 아테네 민족은 헤겔이 보기에 세계사적 지위를 상실하고 몰락의 길에 접어들 수 밖에 없었다.
This article sheds new light on Hegel’s interpretation of Socrates’ Death in his Vorlesungen uber die Geschichte der Philosophie from law-philosophical viewpoint.
For Hegel, Socrates’ Death is not a mere individual tragedy, but a world-historical event in which the contradiction of the ancient ethic of life(Sittlichkeit) is expressed in the form of the tragic fate of a philosopher. Here collide the self-conscious principle of subjective freedom to reach universal individuality inwardly and the simple principle of ethical life(Sittlichkeit) to live on the external command of God unentangledly. In other words, the critical thinking of natural law and the daily ethical practice of positive law collide in Socrates’ philosophy and life as a whole, and it is this conflict which has been sharpened in the course of his lawsuit and execution. This conflict and strife was already unconsciously situated whithin the life of the Athenian people itself. Thus, through the execution of Socrates, the Athenian people have removed their own new principle that demands ethical universality.
And that is, for Hegel, why the Athenian people had to lose their world-historical status and to enter the path of decline.
