본 논문은 미세먼지를 포함한 인도의 대기오염사건과 관련된 인도 대법원 판례를 중심으로 우리나라의 미세먼지 관련 소송에서의 법원의 역할을 고찰하는 것에 목적이 있다. 인도의 대기오염 관련 법제는 1948년 공장규제법, 1952년 광산규제법, 1981년 대기오염 예방 및 통제법, 1986년 환경보호법을 통해 발전되어 왔고, 1988년 자동차법에서 자동차 배기가스의 기준을 명시하면서 대기오염 통제를 다루었고 2000년 오존층 파괴물질의 규제 및 통제 규칙, 2000년 도시 고형 폐기물 관리 및 처리 규칙에서도 대기질 관리와 규제에 대한 법제를 제시하였다. 한편 인도는 타지 트래피지움 사건, 델리 대기오염 사건, 벨로르시민복지 포럼 대 인도 사건 판결을 통해서도 대기오염과 관련한 이론적인 발전이 있었다. 소송례를 분석한 결과 인도에서의 공익소송(Public Interest Litigation; PIL)은 인도 헌법 제32조에 따라 이해관계인에 해당되지 않는다 하더라도 대법원에 청원할 수 있었다. 또한 인도 사법부의 사법적극주의는 권력분립원칙에 어긋난다는 반대에도 불구하고 대기오염과 관련한 판례에 막대한 기여를 하였으며, 비정부기구를 비롯한 환경단체의 역할과 인도 정부의 공공정책을 지침이 되는데 있어서 결정적인 역할을 하였다. 본 연구를 통해 인도는 델리대기오염 사건에서 사익보호성을 적용하는데 있어서 자국 헌법규정 원용하였으나, 미세먼지를 비롯한 대기오염 관련한 우리나라 소송에서 법원은 입법규정의 불비를 이유로 소극적인 입장을 취하고 있다는 차이에 주목했다. 또한 미세먼지는 그로 인한 피해가 심각하므로 ‘공익적’인 특성을 고려하여 소송에 있어서도 사전예방적 관점에서 잠재적 오염자인 국가에 대한 개인의 사익보호성을 인정하여야 한다는 시사점을 도출했다.
This paper aims to consider the court's role in the fine dust-related lawsuits, focusing on India's Supreme Court's ruling on air pollution cases in India. The laws concerning air pollution in India have developed since the Enactment of Factories Act. Meanwhile, India has also achieved theoretical development regarding air pollution through various rulings. It was unique that the Public Interest Litigation(PIL) in India could be petitioned to the Supreme Court under section 32 of the Indian Constitution. In addition, judicial activism in India's judiciary has contributed immensely to cases related to air pollution, and played a crucial role. Since fine dust is seriously harmful, the proactive approach is important. Meanwhile, it came to the conclusion that individuals should recognize their privacy protection against the country, which is a potential polluter, from the perspective of proactive prevention.
