교육공무원의 직무적 특성에 따른 「교육공무원법」 개정방안에 관한 연구

교육공무원은 교육 관련 행정업무에 복무하는 공무원으로서 일반직 공무원과는 구별되는 업무적 특수성을 가지고 있으며, 이에 따른 신분적 차별성이 요청된다. 현재 교육공무원의 복무와 관련하여서는 기본법적 성격을 갖는 「교육공무원법」 에서 상세히 규정하고 있지만, 교육공무원의 업무적 특성을 고려한 신분적 특수성이 교육공무원법에 제대로 반영되어 있지는 않다. 교육공무원의 직무적 특성을 반영하여 현행 교육공무원법을 개정하고자 한다면, 교육공무원의 직무적 특수성을 반영할 필요가 없는 일반직공무원의 직무 관련 조항들은 굳이 교육공무원법에 조항을 두지 아니하고 국가공무원법상의 관련 조항을 준용하도록 하여 법령의 간소화를 도모할 필요가 있다.이를 위해서는 먼저 교육공무원의 직무적 특수성을 반영할 필요가 있는 사항과 동일한 내용이라도 별도로 규정하는 것이 바람직한 사항 등을 구별할 수 있는 이론적 근거가 되는 교육공무원의 직무적 특수성을 파악할 필요가 있으며, 나아가 동일한 규정이 필요한 사무에 대해서는 별도의 규정 없이 일반준용 규정 또는 적용 범위에 관한 관련 규정을 통해 교육공무법상의 특례규정을 강화할 수 있는 개정안을 마련하는 것이 필요하다.

Education officials have a status as public servants, but their distinctive social status and roles are called for by their specific occupational characteristics. The job characteristics and functions they perform vary from one role to the next. Therefore, the legal contents appropriate to their position and role need to be defined in detail in the Education Officials Act. Although general rules applicable to public officials can be applied to educational officials through the application of national civil service law or local civil service law, It must be prescribed in the Decree when in cases that it is necessary to reflect the specificity related to the specific duties of educational public officials. In particular, the professional characteristics of educational officials should be well reflected so that professionalism as a specific public official can be revealed in the case of employment, service, disciplinary action, and guarantee of status. In amending the Education and Civil Service Law, distinguish between provisions that do not apply the national civil service law or local civil service law and the matters to be placed as special provisions in the Education and Public Service Law. It is necessary to distinguish the matters that should be put in place and to stipulate in each statute. The National Civil Service Law stipulates open positions in the hiring of civil servants, but the Educational Civil Service Act does not provide for this, and the National Civil Service Act stipulates the recruitment of public offerings to ensure fairness in the appointment of external public officials but there is no regulation in the Educational Civil Service Act. Therefore, open positions are required in order to hire qualified personnel for the professionalism and effective policy establishment of education officials and it is required the establishment of provisions for this. In relation to the security of the status of educational officials, the current educational civil service law has general provisions. Considering the fact that educational officials are not required to be resigned under the Education Officials Act, it can be said that the security of status of education officials is strengthened. However, in the case of retirement of education officials, it is required adjustment of the law because the national civil service law was revised in 2018 and there are similar regulations to the education civil service law.
