언제부터 어떠한 경위로 만들어지고 사용되어 왔는지 정확히 알려져 있지 않지만 ‘금산분리’라는 용어는 우리나라에서 널리 쓰이고 있다. 그러나 이 용어는 그 뜻이 너무나 광범위하고 모호하여 생산적인 토론에 방해가 되고 여러가지 오해를 불러 일으키고 있다. 더구나 우리가 입법의 모델로 삼는 선진제국에서는 이러한 용어를 쓰지 않으므로 국가간 법제연구나 의사소통에도 문제가 생긴다. 필자는 현재까지 우리나라 학계에서 어느정도 정리되었다고 생각되는 ‘금산분리’의 개념을 살펴보고, 역사적으로 어떠한 경위로 이 용어가 만들어지고 정착 되었는지 추적해 보았다. 그리고 우리나라와 외국의 금융법제사에 비추어 볼 때 이 용어는 부적절한 것임과, 이 용어가 사용됨으로써 야기되어 온 실무적 문제점들을 살펴보았다.

Not being well known about when and how it has been used, the word, ‘Separation of Finance and Commerce’ has been widely used in Korea. However, this terminology is too broad and ambiguous, so that it makes productive discussion impossible and brings about many misunderstandings. Furthermore, this word cause difficulties in comparative studying of financial legislation and international communication because advanced countries that Korea refer to as legislation model do not use this word. I reviewed the concept of ‘Separation of Finance and Commerce’ that, I think, has been somewhat defined until now in Korean academic world. I also traced when and how this word was made and used. Then I tried to prove that this word is wrong and makes many problems which can be avoided if we do not use this word.
