보험상품은 계약의 형태로 존재하는 무형의 금융상품으로 대상 위험이 고도로 전문화되고 복잡해지고 있으므로 보험소비자의 입장에서 보험상품의 내용을 충분히 인지하는 것이 점차 곤란해지고 있다. 보험업법상 설명의무에 대해 규정하고 있는 보험업법 제95조의2는 불완전 판매를 감소시키고 보험소비자의 피해를 미연에 방지하기 위하여 2010년에 신설되었는바, 이에 따라 보험회사 등은 보험계약의 중요 사항을 일반보험계약자가 이해할 수 있도록 설명하여야 한다.
그런데, 보험업법은 설명의 구체적인 방법에 대해 명시하지 않고 있으므로, 원칙적으로 는 구두설명 방식에 의해야 할 것이다. 다만, 보험계약자의 입장에서 당해 보험계약이 정형화 된 계약유형에 해당하는 경우에는 구태여 구두 설명을 듣고 싶지 않은 경우가 발생할 수 있고, 구두설명 방식에 의할 경우 오히려 보험의 모집에 종사하는 개인 별로 말투나 억양, 표준상품설명대본을 읽는 속도 등이 상이한 문제 등으로 인해 보험계약자가 제대로 설명을 들었는지 여부에 관한 보험민원이 제기되는 경우가 존재한다.
따라서, 이 글에서는 보험업법상 설명의무와 관련하여 구두설명 방식을 유선·무선 등의 방식으로 대신하는 방법을 포함하여 그 구체적인 이행방법에 대한 규제완화 가능성을 살펴보았다. 구체적으로, 보험업법상 설명의무의 주요 내용과 그 이행방법에 관한 문제점을 살펴보고 금융당국의 유권해석 사례 및 대법원 판례의 입장을 근거로 설명의무 이행의 판단 기준과 그 이행방법의 변경 가능성에 관한 개선방안을 검토하였다. 보험업법상 설명의무의 이행에 대해서는 보험모집 종사자와 보험계약자 사이의 상호 작용을 통해 보험소비자가 보험계약의 중요한 사항을 제대로 파악하고 보험에 가입하였는지 여부가 실질적인 판단 기준이 될 것이므로, 설명의무 이행방법에 대한 규제 완화를 검토함에 있어서는 보험계약자에 대해 보험상품의 내용을 상세히 설명하고, 질문과 답변 과정을 통해 보험모집 종사자 등과 직접적인 소통을 하는 것에 준하는 정도의 상호 소통과정이 수반되어야 한다는 점을 바탕으로 합리적이고 유연한 규제 완화 방안을 적극적으로 고려하여야 할 것이다.
Insurance products are intangible financial products that exist in contract form. As their risk as objects becomes highly professional and complicated, it is increasingly more difficult for insurance consumers to fully familiarize themselves with the content of an insurance product. In 2010, the Insurance Business Act added Article 95, Clause 2, which stipulates a duty of explanation, to reduce incomplete sales and prevent damage to insurance consumers. As a result, insurance companies are obliged to explain important matters of an insurance contract in a way that common policyholders can understand.
The Insurance Business Act has no explicit provisions about the specific methods of explanation, which means that oral explanations would be required in principle. On the part of policyholders, however, they may not wish to listen to oral explanations, in particular, when their insurance contracts are standard ones. Offering explanations orally, insurance solicitors will vary in tone, intonation, and rate of reading the standard product explanation script, in which case insurance complaints might be raised over whether the policyholder has listened to the explanations correctly.
Thus, this study set out to explore the possibilities of easing the regulations of the methods to replace oral explanations with wired and wireless ones in relation to the duty of explanation under the Insurance Business Act as well as the specific methods of fulfilling that duty. Specifically, the study examined the major content of the duty of explanation in the Insurance Business Act and problems with the methods of fulfilling that duty and reviewed the judgment criteria of fulfilling the duty of explanation and improvement measures for the possibilities of changing the methods of fulfillment based on the cases of authoritative interpretations by the financial authorities and the Supreme Court's precedents. In the fulfillment of duty of explanations in the Insurance Business Act, a practical criterion of judgment would be to figure out whether insurance consumers have purchased an insurance product after understanding the important matters of that insurance contract fully through their interactions with insurance solicitors. In a review to ease the regulations about the fulfillment methods of duty of explanation, it is thus needed to take into active consideration rational and flexible plans for the ease of regulations based on the idea that policyholders should have mutual communication with insurance solicitors involving detailed explanations about the content of an insurance product and direct communication between them based on questions and answers.
