공무원의 정치적 중립에 대한 논의는 민주화 등의 거대한 물결을 거치면서 정치적 중립의 폐기론까지 주장될 정도로 복잡한 것으로 진화해왔다. 그럼에도 불구하고 한국에서 공무원의 정치적 중립은 여전히 중요하고 필요한 시대적 규범이라는 것을 3가지 점에서 논의한다. 먼저, 기존의 정치적 중립 논의는 실제 공무원들의 경험과 행위를 설명하는 것에 있어서 한계를 갖는다. 그 한계는 복 주인 문제, 복 대리인 문제, 관료정치의 문제 등 세 가지로 정리된다. 둘째, 민주정치의 진화과정을 고려할 때 공무원의 정치적 중립이란 개념 재정의하면서 공익실현을 위해 매우 중요함을 주장한다. 공익실현을 위한 수단으로서의 정치적 중립을 담보하기 위하여, 공무원은 정치인에 대하여 비교우위가 있다는 점을 강조한다. 따라서 공무원들은 직무수행에 있어서 좀 더 적극적 역할을 할 것이 요구된다고 하겠다. 마지막으로, 실제 공무원이 정치적 중립을 실천하기 위하여 고려해야 할 판단기준을 제시한다. 이 기준은 사안의 합법성, 중대성, 그리고 시급성이며, 이에 부가적으로 활용할 수 있는 전략 등을 부연한다.

Discussions on the political neutrality (PN) of civil servants have evolved into a complex debate in which calls for the abolition of PN have even been raised. This paper nevertheless stresses that the political neutrality of civil servants is still an important norm of the time. This paper contains three main arguments. Firstly, the existing discussion of PN has limitations―multiple principal problem, multiple agent problem, and bureaucratic politics problem―in explaining the praxis of actual civil servants. Secondly, to overcome these limitations and preserve PN, it is necessary to redefine PN as public interest. In order to safeguard PN as public interest, the active role of civil servants, who have a comparative advantage in that matter over politicians, is called upon. Finally, this paper presents practical criteria for judgment―legitimacy, case importance, and case urgency―that civil servants should consider in practicing PN.
