2020년 2월 4일 병(兵)에 대한 징계 종류를 규정한 「군인사법」 제57조 제2항 개정으로 징계 중 ‘영창’이 폐지되고, ‘군기 교육’, ‘감봉’, ‘견책’이 새로운 징계 종류로 추가되었다. 개정 이유에서도 밝히고 있듯이 이번 개정의 목적은 병의 인권을 신장하는 데 있다. 이 조항이 2020년 8월 5일부터 시행됨에 따라 국방부는 「군인 징계령」 등 관련 법령 및 규칙 개정과 관련 지침 마련에 박차를 가하고 있다. 그러나 영창을 폐지하는 대신 도입된 군기 교육은 영창에 관해 제기되었던 문제점을 모두 해소하였는지는 여전히 의문이다. 본 연구에서는 종래 영창제도의 문제점이 무엇이었는지 검토하고, 대체 징계벌목으로서의 군기 교육이 그 문제점을 해소하는 대안인지 여부를 비판적으로 논의하였다. 그리고 결론에 갈음하여, 이미 시행이 예정된 군기 교육 제도가 인권 친화적이면서도 군의 기강 확립에 효과적인 수단이 될 수 있는 방안을 제언하였다.

On February 4th, 2020, Paragraph 2 of Article 54 of the Military Personnel Management Act was amended by removing “detention in a guardhouse” and adding “military discipline education,” “forfeiture of pay,” “reprimand” as non-judicial punitive measures for the rank and file of the military. The stated rationale for the amendment was to strengthen protection of the rights of enlisted personnel. As the amendment will be effective on August 5, 2020, the Ministry of National Defense has stepped up its efforts to revise related laws and rules, including the Military Disciplinary Ordinance, and to prepare related guidelines. It is nonetheless questionable whether the military discipline education that supersedes detention in guardhouse as a non-judicial punitive measure has addressed issues raised against the custodial measure. This study reviews the problems in respect to the traditional punitive measure of detention in a guardhouse and critically examines whether the newly instated measure of military discipline education as an alternative creates the conditions conducive to promoting human rights and establishing good order and discipline in the military.
