지난 세기동안 우리나라는 개발위주 경제정책을 바탕으로 경제발전과 경제위기 극복을 위해 정부의 공적자금을 주로 기업에게 지원해 왔던 것이 주지의 사실이다. 그러나 최근 전국을 강타한 감염병의 확산으로 인해 경기가 급격하게 침체되자, 그간의 경제 정책방향과는 다르게 정부의 공적자금을 전국민에게 사용해야 한다는 논의가 활발하게 진행되었고, 모든 국민에게 재난기본소득을 지급하기로 결정하였다. 모든 국민에게 재난기본소득을 지급하기로 결정하였다고 해서 정부의 공적자금 지원에 대한 모든 논의가 해결된 것은 아니다. 그렇다면 이러한 논란을 해소하기 위해서도 정부의 공적자금 지원이 법리적으로 어떠한 지에 대해 살펴보아야 할 필요가 있다. 법리적으로 우리나라의 공적자금 지원과 관련하여 법제도화가 추진된 것은 1997년 외환위기를 겪으면서 국가적 위기상황에 대응하기 위하여 논의되기 시작하였고, 2000년 12월 「공적자금관리특별법」이 제정되었으며, 이 후 몇 번의 개정을 거치게 되었다. 결국 정부의 공적자금 지원에 대한 문제를 규명하기 위해서는 현행 법제도에 대한 구체적인 검토가 선행되어야 한다. 특히, 정부의 공적자금 지원의 한계를 명확히 규명하여 논란을 해소할 필요가 있다.

It is a well-known fact that during the past century, Korea has spent government’s public funds mainly for corporations to boost economic development and overcome financial crises based on development-oriented economic policy. However, as the economy has rapidly fallen due to the spread of the pandemic that hit the country hard recently, there has been an active discussion that the government should use public funds for the public, unlike the economic policy direction so far. As a result, the government has decided to pay anti-disaster basic income to all citizens. Unfortunately, the decision to pay anti-disaster basic income to all citizens does not resolve all issues about the government's public funding. Therefore, in order to resolve the controversies, it is necessary to look into what the government's public funding support is in juridical sense. The legalization of Korea's public funding support through the juridical process began to be pushed forward in response to the national crisis during the 1997 global financial crisis. And it resulted in the enactment of the 「Special Act on the Management of Public Funds」 in December 2000, which has gone through several revisions since then. In summary, a detailed review of the current legal system must be preceded in order to identify the government's public funding problems. In particular, it is necessary to clarify the criteria of the government's public funding support so as to resolve the controversies.
